§ 47 Motor vehicle parking spaces and garages

(1) Structures and other facilities where access or departure traffic is to be expected may only be erected if parking spaces are provided in sufficient number and size and quality (necessary motor vehicle parking spaces). Their number and size shall be determined by the type and number of existing and expected motor vehicles of the users and visitors of the facilities; the possibility of using public transport shall be taken into account. (...) Parking places for bicycles shall be provided insofar as access and departure traffic with bicycles is to be expected and traffic needs require it.

Summary: In sufficient number and size. Parking places for bicycles shall be provided where access and egress traffic with bicycles is anticipated and traffic needs require it. More detailed regulation by legal ordinances or by local building regulations.

Exceptions

§ 47 Motor vehicle parking spaces and garages

(2) If structural facilities or other facilities where access or departure traffic is to be expected are altered or if their use changes, parking spaces shall be provided in such number and size that they can accommodate the additional motor vehicles to be expected as a result of the alteration. This shall not apply if living space is created in buildings which were completed at least two years ago by dividing the dwelling, changing the use, adding storeys or by extending the attic storey and the construction of parking spaces or garages on the property is not possible or only possible with great difficulty;

(4) If the construction of necessary parking spaces or garages is not possible or only possible with great difficulty or if it is prohibited or restricted on the basis of a statute pursuant to § 88 para. 3, the developer may, if the municipality agrees, also fulfil the obligations under paragraphs 1, 2 and 3 by paying a sum of money to the municipality. The monetary amount shall not exceed 60 percent of the average cost of construction of the parking facilities, including the cost of land acquisition. The amount of money per parking space or garage shall be determined by statute.

Supplement

§ 62 Projects exempt from approval

(1) Notwithstanding a permit required under other regulations, no building permit shall be required for the erection, construction, setting up, installation or alteration of the following structures, other installations and facilities:
1. Buildings

f) Garages, covered parking spaces and storage spaces for bicycles with a floor area of up to 50 m² and an average wall height of the outer walls of no more than 3.20 m each, in the case of walls with gables a ridge height of no more than 4 m; with the exception of garages, covered parking spaces and storage spaces for bicycles in outdoor areas and in the vicinity of cultural and natural monuments.
