§ 47 Motor vehicle parking spaces and garages, parking places for bicycles

(1) In the case of construction of buildings and other facilities where access and departure traffic is to be expected, parking spaces or garages must be provided in sufficient number, size and suitable quality (necessary motor vehicle parking spaces and garages). Their number and size shall be determined by the type and number of existing and, taking into account local traffic conditions and local public transport, expected motor vehicles of the permanent users and visitors of the facilities. In the case of alterations to facilities in accordance with sentence 1 or changes in their use, only the additional parking spaces and garages required as a result of the alteration must be provided. The parking space requirement shall not apply to residential buildings with up to two apartments.

(4) Para. 1, sentences 1 to 3 shall apply mutatis mutandis to the construction of parking places for bicycles. Bicycle parking places shall be provided on the building plot. The obligation to provide bicycle parking places shall not apply to residential buildings insofar as the provision of bicycle parking places for visitors is not possible on the building site or is possible only with great difficulty.

Summary: In sufficient number, size and suitable quality. No parking space requirement for residential buildings with up to two apartments.

Exceptions

§ 47 Motor vehicle parking spaces and garages, parking places for bicycles

(3) If the construction of necessary parking spaces or garages is not possible or only possible with great difficulty, or if it is prohibited or restricted on the basis of a statute pursuant to § 88 (3), the developer may, if the municipality agrees, also fulfil the obligations pursuant to subsections (1), (2) and (3) by paying a monetary amount to the municipality. The monetary amount shall not exceed 60 percent of the average cost of construction of the parking facilities, including the cost of land acquisition. The amount of money per parking space or garage shall be determined by statute.
