§ 47 Parking spaces and garages
(1) Structures as well as other facilities where access or departure traffic is to be expected may only be erected if parking spaces are provided in sufficient number and size as well as in a suitable condition (necessary parking spaces). Their number and size shall be determined by the type and number of existing and expected motor vehicles of users and visitors to the facilities, taking into account the possibility of using public transport. (...) Parking spaces for bicycles shall be provided to the extent that access and departure traffic with bicycles is expected and traffic needs require it.
Summary: In sufficient number and size. Parking spaces for bicycles shall be provided where access and egress traffic with bicycles is anticipated and traffic needs require it. More detailed regulation by legal ordinances or by local building regulations.
Exceptions
§ 47 Parking spaces and garages
(2) If structures or other facilities where access or egress traffic is anticipated are altered or their use changes, parking spaces shall be provided in such number and size as to accommodate the additional motor vehicles anticipated as a result of the alteration. This does not apply if living space is created in buildings that were completed at least two years ago by dividing the apartment, changing the use, adding a storey or by extending the attic and the construction of parking spaces or garages on the property is not possible or only possible with great difficulty;
(4) If the construction of necessary parking spaces or garages is not possible or only possible with great difficulty or if it is not possible due to a statute according to § 88 para. 3 is prohibited or restricted, the developer may, if the municipality agrees, also fulfill the obligations under paragraphs 1, 2 and 3 by paying a sum of money to the municipality. The monetary amount shall not exceed 60 percent of the average cost of constructing the parking facilities, including the cost of land acquisition. The amount of money per parking space or garage shall be determined by statute.
Supplements
§ 62 Projects exempt from approval
(1) Notwithstanding any permit required by other regulations, no building permit shall be required for the erection, construction, placement, installation or alteration of the following structures, other facilities and equipment:
1. building
f) garages, covered parking spaces and bicycle parking spaces with a floor area of up to 50 m² and an average wall height of the exterior walls of no more than 3.20 m each, and a ridge height of no more than 4 m for walls with gables; garages, covered parking spaces and bicycle parking spaces in the outdoor area and in the vicinity of cultural and natural monuments are excluded.
