§ 48 Parking spaces for motor vehicles and bicycle spaces
(1) If structural facilities and other facilities are erected where access and departure traffic is to be expected, parking spaces for motor vehicles as well as bicycle spaces shall be provided or proven on the property or, secured by building encumbrance, on a suitable property in the vicinity in a suitable condition (necessary parking spaces and necessary bicycle spaces). Their number and size shall be determined by the type and number of existing and expected motor vehicles and bicycles of the permanent users and visitors of the facilities. In the event of changes to the facility and changes in use which lead to changes in the number and size of the necessary parking spaces and necessary bicycle spaces in accordance with sentence 2, only parking spaces and bicycle spaces for the additional requirements as a result of the changes are to be provided. (
2) The accommodation of children's play areas as well as required bicycle spaces on the property shall take precedence over the accommodation of parking spaces.
(3) Required parking spaces and required bicycle spaces shall not be used for purposes other than those for which they are intended. Individual parking spaces in existing garages may be used as bicycle spaces.
Summary: Number and size by type and number of existing and anticipated motor vehicles and bicycles of permanent users and visitors to the facilities.
Exceptions
§ 49 Compensatory levy for parking spaces and bicycle spaces
(1) The obligation under Section 48 shall be fulfilled by payment of a compensation amount to the Free and Hanseatic City of Hamburg if necessary parking spaces or necessary bicycle spaces cannot be produced or provided or can only be produced or provided with unreasonable difficulty, or if necessary parking spaces are to be used as parking spaces for apartments or dormitories (Section 48 (1a)) and the parking spaces for apartments or dormitories cannot otherwise be produced or can only be produced with unreasonable difficulty.

§ 48 Parking spaces for motor vehicles and bicycle spaces
(1a) In the case of apartments or residential homes, the building owners decide on their own responsibility about the creation of parking spaces to an appropriate extent, taking into account the parking space requirements of the residents, the local traffic conditions, the connection to public transport and, in particular, the needs of people with mobility impairments.
