§ 49 Necessary parking spaces and necessary parking spaces for bicycles
(1) In the case of the construction, alteration or change of use of buildings and other facilities where access or departure traffic by means of motor vehicles or bicycles is to be expected, the necessary parking spaces or necessary parking spaces for bicycles specified by the municipality in a local building regulation in accordance with § 87 must be provided.
(2) The necessary parking spaces as well as the necessary parking spaces for bicycles shall be provided on the building plot or at a reasonable distance therefrom on a suitable plot of land, the use of which for this purpose shall be secured under public law.
Summary: Decision is up to the municipalities.
Exceptions
Criteria: traffic, economic policy or urban planning reasons or if parking spaces are available for general use in sufficient numbers.

(4) The municipality shall use the amount of money for the redemption of necessary parking spaces or of necessary parking spaces for bicycles for the construction of additional or the maintenance, repair or modernization of existing parking facilities or the construction of charging infrastructure for electric vehicles, other measures to relieve the streets from stationary traffic including investment measures of local public transport and measures to improve bicycle traffic, the construction of parking facilities for the shared use of motor vehicles (car sharing).
(5) The building inspection authority may permit required parking spaces or required bicycle parking spaces to be constructed only within a reasonable time after completion of the development. It shall suspend construction as long as and to the extent that there is a demonstrable lack of demand for necessary parking spaces or necessary parking spaces for bicycles and the areas required for construction are secured for this purpose by building encumbrance.
