§ 48 Required parking spaces, garages and parking spaces for bicycles

(1) If building structures are erected where access and departure traffic with motor vehicles or bicycles is to be expected, parking spaces for motor vehicles (necessary parking spaces) as well as parking spaces for bicycles shall be provided on the building site or at a reasonable distance therefrom on a suitable plot of land whose use for this purpose is secured under public law, insofar as this is required by a local building regulation pursuant to § 85 para. 1 sentence 4 is determined. In the event of alterations or changes in the use of built facilities, parking spaces may only be required for the additional demand. The areas for necessary parking spaces can also be arranged in garages.

Summary: No mandatory regulation, empowerment of municipalities. Restriction of the obligation to pay the fee, determination of the amount of money only from the eighth parking space onwards

Exceptions

§ 48 Required parking spaces, garages and parking spaces for bicycles

(2) If the production of necessary parking spaces is not possible or only possible with great difficulty, the municipality may demand that the party obligated to produce them pay a monetary amount in lieu thereof. The monetary amount shall not exceed 60 percent of the average cost of construction of parking facilities, including the cost of land acquisition, in the municipality or in certain parts of the municipality. In determining the monetary amount, the first eight parking spaces shall be disregarded.

§ 85 Local building regulations

(1) (...) Municipalities may also issue local building regulations on the number, size and nature of the necessary parking spaces and parking spaces for bicycles in accordance with § 48 para. 1, which are necessary, taking into account the safety and ease of traffic, the needs of stationary traffic and the development by public transport facilities for structural facilities, including the additional requirements in the event of changes or changes in use of the structural facilities, and the redemption of the production obligation and the amount of the redemption amounts within the framework of § 48 para. 2 and 3, which may be regulated differently according to the type of use and location of the building structure.
